IMPORTANT DEVELOPMENTS IN GILTI CASE AND OUR FIGHT
New developments in GILTI case and our fight
First, the judge ruled in our favor. It rejected the government’s motion to dismiss. We have one motion left to win the case – motion for summary judgment.

Second, a month before the above ruling, I filed a freedom of information act request (FOIA) seeking documents from the IRS and Department of Justice that show improper communication between the government and the judges in my GILTI and Transition cases.

Was the ruling in #1 related to my action in #2? I think it was. I do know is that in the past, my aggressive actions (asking the appeals court to force the judge to rule) resulted in immediate and favorable action by the judge. The same happened again with the FOIA.
Since the government failed to respond to my FOIA request I can and will file a lawsuit looking for proof of the improper communications between the judge and the government. I believe that it is only by applying pressure that I will get fair treatment from the court.
